无人驾驶汽车事故成因分析与责任划分 被引量:3

摘要 为理清无人驾驶汽车事故原因及划分出现的无人驾驶事故责任,分析无人驾驶汽车等级分类,对比分析无人驾驶汽车和传统汽车交通事故成因的不同点,给出无人驾驶汽车事故划分原则与依据。根据交通事故参与方不同,参照现行《中华人民共和国道路交通安全法》,提出无人驾驶交通事故赔偿原则。基于实例,提出无人驾驶汽车交通事故责任划分与建议。研究结果能为无人驾驶汽车事故成因分析提供参考,为制定相关无人驾驶汽车事故责任划分及赔偿法律法规等提供依据。 In order to clarify the causes of driverless car accidents and the responsibility of dividing the driveriess car accidents, the classification of driverless car grade is analyzed, the differences between the driverless car and the traditional car accidents are compared and analyzed, and the principle and basis for the division of driverless car accidents is given. According to the existing road traffic safety law of People- s Republic of China, the principle of compensation about driverless car accidents is put forward referring to the traffic accident participants. Based on an example, the responsibilities and suggestions for traffic accidents of driverless car are put forward. The research result can provide a reference for the accident causes of driverless car, and provide a basis for making laws and regulations about relevant responsibilities and compensation of driverless car accidents.
