浅议互联网环境下个人隐私权的宪法保护

On Constitutional Protection of Personal Privacy in the Internet Environment

近些年,中国在互联网和计算机方面的相关技术得到了空前的发展,一时之间,各种智能设备和互联网电商、社交软件等内容不断兴起。目前为止,已有多种互联网技术种类几近取代了国内传统行业。但从近期网络上不断发生的用户信息失窃、用户隐私权受侵等现象。体现了在互联网环境下,公民的个人隐私权似乎并不能得到有效的维护与保障。因此,从宪法保护层面入手,研究互联网环境下个人隐私权的宪法保护。

In recent years, the technology concerned with Internet and computer has got unprecedentedly developed. For a time, various smart devices and Internet e-commerce, social software are booming. So far, various Internet technologies have almost replaced the traditional domestic industries. However, the recent theft of user information and the infringement of user privacy in the network show that citizens’ personal privacy does not seem to be effectively maintained and guaranteed in the Internet environment. Therefore, this paper studies constitutional protection of personal privacy in the Internet environment on the level of constitutional protection.
