宪法视域下体育赛事的转播侵权研究

On the Infringement of Sports Events from the Perspective of Constitution

体育赛事类节目既包括使用各种媒介对体育赛事的直播、转播,也包括与体育赛事相关的访谈类、新闻类节目。为了对体育赛事类节目进行规范和保护,必须对相关法律进行进一步的完善和优化。从体育赛事直播或转播、体育赛事衍生节目2个方面,对其法律性质和权利配置进行了简要的分析。并在宪法视域下,探讨了当前我国对体育赛事类节目法律保护制度存在的缺陷,进一步提出了相应的完善措施,旨在加强对体育赛事类节目的法律保护力度。

Sports events include both live and broadcast of sporting events using various media,as well as interviews and news programs related. In order to regulate and protect sports events,it is necessary to further improve and optimize the relevant laws. This paper analyzes the legal nature and the allocation of rights from two aspects： live or broadcast of sports events and derivative programs of sports events. And in the view of the Constitution,this paper discusses the shortcomings of the current legal protection system of sports events in China,and further puts forward the corresponding measures to strengthen the legal protection of sports events.
