企业签订技术合同中知识产权的问题研究

由于企业不断发展,技术不断更新,涉及技术开发、许可、转让、咨询服务等合同日益增多。但是,企业对技术合同中知识产权问题的理解和处理还不够清晰,缺乏有效的应对处理措施。文章将结合技术合同中有关知识产权的条款起草、审核、签署、履行的实践经验,以及在后期纠纷维权中出现的问题,提出企业如何正确处理技术合同中知识产权的问题建议和方案,以便规范技术合同订立的合理性和合法性,降低违约和侵权风险,促进企业发展。

Due to the continuous development of enterprises, technology is constantly updated, involving technology development, licensing, transfer, consulting services and other contracts are increasing, but the understanding and treatment of intellectual property issues in technology contracts is not clear enough, the lack of effective response measures. This article will combine the practical experience of drafting, checking, signing and fulfilling the intellectual property clauses in the technical contract, and the problems arising in the later disputes to safeguard the intellectual property rights, and put forward the suggestions and schemes on how to correctly handle the intellectual property rights in the technical contract, so as to standardize the rationality and legitimacy of the technical contract. It will reduce the risk of default and infringement, promote the development of enterprises.
