城市园林绿化废弃物循环利用的法律规制

Legal Regulation on recycling of urban gardening waste

我国城市化进程不断加速,大中小城市的规模与数量与日俱增。城区面积的日趋扩大,使得城市绿化事业也得到迅猛发展。必然导致了我国城市园林绿化废弃物的总量不断攀升,然而传统的处理园林废弃物的方式已经很难适应当前习近平总书记要求的绿色低碳的发展原则。尤其是我国传统的处理方式,如填埋与焚烧的处置方式。这两种处置方式长期以来饱受公众的诟病,也不符合建设环境友好型与资源节约型的发展理念。因此,如何建构一个符合绿色发展理念,又能满足城市园林绿化发展事业的废弃物循环利用之规制,成为当前我们园林绿化事业发展的重中之重。目前,检视已有的园林绿化废弃物循环利用的法律规制,存在立法理念稍显滞后、法规体系尚不完备、管理部门权责不明确等问题。为此,我们认为有必要借鉴国外成熟的立法经验,不断完善我国城市园林废弃物循环利用法律制度。如此,方能实现习近平总书记提出的建设富强民主文明和谐美丽社会主义现代化强国。

the process of urbanization in China is accelerating,and the size and quantity of large and medium-sized cities are increasing.Withthe increasing urban area,the cause of urban greening has also been developing rapidly.It will inevitably lead to the continuous increase of the totalamount of urban landscaping waste in China.However,the traditional way of dealing with garden waste has been difficult to adapt to the currentrequirements of General Secretary Xi Jinping green low-carbon development principles.In particular,our traditional treatment methods,such aslandfill and incineration disposal.These two disposal methods have been criticized by the public for a long time,and do not conform to the conceptof scientific construction of environmental friendly and resource-saving development.Therefore,how to construct a green development concept,butalso to meet the development of urban landscaping waste recycling regulations,become the current development of our landscaping priority.Atpresent,reviewing the existing laws and regulations on the recycling of gardening wastes,there are some problems,such as the lagging of legislativeconcepts,imperfect legal system,and unclear power and responsibility of management departments.Therefore,we think it is necessary to learn fromthe mature legislative experience of foreign countries,and constantly improve the legal system of recycling urban garden waste in China.Only in thisway can we realize the construction of a prosperous,democratic,civilized,harmonious and beautiful socialist modernization power proposed by GeneralSecretary Xi Jinping.
