工程项目招标中暂估价的设置比例研究

暂估价的概念自《工程建设项目货物招标投标办法》(2005年七部委令第27号)首次提出以来,受得到了极大的欢迎.在相关法律法规相继做出规定的同时,招标人使用暂估价招标的工程数量和规模逐步增大,对于暂估价的利弊等的研究也有很多,但对于暂估价的设置比例问题鲜有法律文件和研究文献提及.论文从招标人可承担价格风险的角度用概率的方法分析暂估价的设置比例,能够为暂估价设置比例的立法和实施提供参考。

The concept of provisional valuation has been verypopular since the first proposal of＂Goods Bidding and Tendering Methods of Construction Projects＂ （Order No. 27 ofSeven Ministryin 2005）, and it has been greatly sought after. At the same time, the relevant laws and regulations are have made provisions in succession. The number and scale of tenders using provisional valuation tenders have been gradually increased. There are many researches on the advantages and disadvantages of the provisional valuation, but few legal documents and research literature mention the issue of the setting proportion of the provisional valuation. From the point of view that the tenderer can bear the price risk, this paper analyzes the setting proportion of the provisional valuation with probability method, hoping to provide a reference for the legislation and implementation of the setting proportion of the provisional valuation.
