劳动法教学中引入诊所教育是近年来重要趋势之一。劳动法诊所教育在域外特别是美国经过几十年的发展已经较为成熟,在我国的发展还需要不断完善相关的规则。在劳动法诊所教育开展中,特别是案件的筛选和办理中,需要遵循基本的准则:要倡导真实性原则,选择实践中出现的案例;遵循合法性原则,从实体和程序上力求合法正当;强调法理性,提升劳动法诊所教育的法律性;坚持广泛性原则,打破传统观念的劳动法诊所业务范围的限制;发挥学生自主性,以自主学习促进劳动法诊所教育的实效。
