摘要 劳动法教学中引入诊所教育是近年来重要趋势之一。劳动法诊所教育在域外特别是美国经过几十年的发展已经较为成熟,在我国的发展还需要不断完善相关的规则。在劳动法诊所教育开展中,特别是案件的筛选和办理中,需要遵循基本的准则:要倡导真实性原则,选择实践中出现的案例;遵循合法性原则,从实体和程序上力求合法正当;强调法理性,提升劳动法诊所教育的法律性;坚持广泛性原则,打破传统观念的劳动法诊所业务范围的限制;发挥学生自主性,以自主学习促进劳动法诊所教育的实效。 The introduction of clinic education in labor law is one of the important trends in recent years. Labor law clinic education in the United States, especially after decades of development, has been relatively mature, China’s development needs to constantly improve the relevant rules. Basic guidelines need to be followed in the conduct of education in labor law clinics, particularlyin the selection and handling of cases, to advocate the principle of authenticity, choose cases that appear in practice, follow theprinciple of legality and seek to be legal and legitimate in terms of entity and procedure. It emphasizes the legal reason and enhancesthe legal nature of the labor law clinic education, to adhere to the principle of universality and break the limitation of the scope ofoperation of labor law clinics, develop students ‘autonomy and promote the effectiveness of labor law clinic education through independent learning.
