对“以审判为中心”内涵的法理解读——基于新时代中国特色社会主义法治理论视角

The Legal Interpretation for“the Trial-centered”:Based on the Perspective of Chinese Socialist Rule of Law Theory in the New Era

党的十八届四中全会通过的《中共中央全面推进依法治国若干重大问题的决定》明确提出,要"推进以审判为中心的诉讼制度改革",这为完善诉讼制度、保证司法公正指明了方向,是党在新时代作出的重大改革。刑诉法学者围绕比较法的研究,聚焦庭审实质化,对该项改革进行了深入且具体的研究,但同时也存在着视角较为单一、以旧理论阐释新改革的缺陷。因此需要以改革文本为基础,以中国特色主义法治理论为整体视角,以刑诉法学者的研究为部分视角,对"以审判为中心"的内涵进行重新解读。此次改革的背景是全面深化改革下的具体改革、问题导向下的改革,工作重点为审判中心、庭审中心、证据中心、法律中心、程序中心五大部分。

The Decision of the CPC Central Committee on Major Issues Pertaining to Comprehensively Promoting the Rule of Law passed by the Fourth Plenary Session of the Eighteenth Central Committee clearly stated that the trial centered reform of criminal procedures, a major reform made by the CPC Central Committee in the new era, should be advanced, which points the way for improving the litigation system and ensuring judicial justice. Scholars on criminal procedures have conducted in depth and specific research on this reform, focusing on the study of comparative law and the substantialization of the court trial. However, their perspective is single and their research is old. Based on the text of this reform, this paper reinterprets ＂the trial centered＂, taking the theory of socialist rule of law with Chinese characteristics as the holistic perspective and the research of scholars on criminal procedures as the partial perspective, and holds that this reform is on the background of the specific reform under comprehensively deepening reform and the problem orientated conservative reform, concentrated on the trialcentered, the court trial centered, the evidene-eentered, the laweentered, and the proeedure-centered reform.
