摘要
在新时代背景下,高校法学专业加强法律职业伦理教育的现实紧迫性应得到重视。依照《普通高等学校本科专业类教学质量国家标准》,应将法律职业伦理课程设置为核心专业必修课,并落实如下基本要求:以塑造和追求法治信仰为精神内核;以遵循和恪守法律职业道德为实践要旨。应从如下四个方面强化法律职业伦理教育的实践路径:在课程基本设计方案上,将课程设计为2-3个学分、32-48个学时的课程体量,在第四学期或第五学期开设该课程;在人力资源保障上,在法学一级博士学位培养体系的法理学或诉讼法学下设独立的"法律职业伦理"培养方向,培养与该学科教学、科研相关的专门人才;在教学内容设计上,应设计为法律职业伦理基本理论、伦理规范总论、伦理规范分论、伦理实施机制四编合计12章内容;在教学方法上,采纳讲演、案例、法律诊所、实训四类教学法相结合。
Against the background of new era, the urgency of strengthening legal professional ethics education in law majors in universities should be paid attention to. In accordance with the National Standard for Teaching Quality of Undergraduate Majors in Ordinary Institutions of Higher Learning, the course of legal professional ethics should be set up as a core professional compulsory subject. The following basic requirements should be implemented : shaping and pursuing belief in the rule of law as the spiritual core ; following and abiding by the legal professional ethics as practical key notes. Legal professional ethics education should be strengthened in the following four aspects. The course can be designed to be 2 -3 credits, 32 -48 classes. It will be taken in the fourth or fifth semester. In this course. There will an independent legal professional ethics training under the first-level doctoral training system to train specialized personnel for teaching and research of the subject. The course should be designed as the basic theory of legal professional ethics, the general theory of ethics, the division of ethical norms, and the ethical implementation mechanism. There are 12 chapters in total. The course should be taught with lecture methods, case teaching methods, and legal clinics. The training method should be combined.
