竞争性国企核心竞争力的提升:现状、探源及反垄断法制完善——由中美贸易战中兴事件说起

The Promotion of the Core Competitiveness of Competitive State-owned Enterprises: Status Quo,Source and Improvement of Anti-monopoly Law——From the ZTE Event in Sino-US Trade War

2018年上半年中兴通讯遭遇的"缺芯之痛"不仅使中美贸易战备受关注,更引发国人对于我国企业尤其是竞争性国企以自主创新为主的核心竞争力提升问题的反思。处于我国新一轮国企改革大潮中的竞争性国企在历次国企改革之后效率已大大提升,但是近年来依赖资源、政策等传统竞争优势逐渐形成的垄断或市场支配地位不仅备受民企诟病,也抑制了其进一步自主创新的动力。在混改背景下,由资源政策优势走向以自主创新为主的竞争优势将是竞争性国企提升核心竞争力的主要路径。而围绕不断打破制约其核心竞争力提升的外部竞争环境培养之囹圄,进行相应的反垄断法制创新与完善,则是竞争性国企核心竞争力提升中不可或缺的重要环节。

In the first half of 2018,the pain of ＂lack of core＂encountered by ZTE not only made Sino-US trade war get more concern,but also aroused people＇s reflection on the enhancement of core competitiveness of Chinese enterprises,especially those of competitive state-owned enterprises. In the new round of reform of state-owned enterprises,the competitive state-owned enterprises have greatly improved the efficiency after the previous reforms,however,in recent years,the monopoly or market dominance,which has gradually formed on the traditional competitive advantages such as resources,policies and so on,has been criticized by the private enterprises,but also inhibited the impetus of further independent innovation of state-owned enterprises. Under the background of continuous mixed ownership reform,the main path dependence of competitive state-owned enterprises to enhance their core competitiveness will be from resource policy advantage to competitive advantage. It is an indispensable part of the core competitiveness of competitive state-owned enterprises to innovate and perfect the corresponding anti-monopoly legal system around the prison of external competitive environment that restricts the promotion of its core competitiveness.
