The Reality and Ideal of Administration According to Law

自1999年,我国将"依法治国"正式写入宪法,全国上下各个行业和部门都纷纷提出依法治市、依法治校、依法治厂、依法治村等口号。在行政领域,最熟悉的就是确立了依法行政原则。2004年,国务院发布了《全面推进依法行政实施纲要》。然而,现实是依法行政只是停留于人们的理想中,今年以来发生的上海钓鱼案、成都拆迁自焚案、深圳出台针对非正常上访可以劳教的通知等案件都在提醒我们:现实的困局要真正实现依法行政还有很长的道路要走。

Since 1999,China have formally written 'rule of law' into the Constitution,the whole country in various industries and sectors have proposed 'Municipal by Law','School by Law','Plants by Law','Village by Law',and other slogans.In the administration field,the most familiar is the principle of administration according to law.In 2004,the State Council promulgated the 'Implementation Outline for full duties according to law.' However,the reality is that administration according to law only stay in people's ideals.That the case of fishing occurred in Shanghai,self-immolation case of demolition in chengdu,and Shenzhen petition can be issued for non-normal cases of detention of notification remind us: administration according to law in the reality of the dilemma still need long way to go.
