农村土地流转中介组织的法律思考

Legal Consideration on Intermediary Organizations of Rural Land Transfer

党的十七届三中全会《关于推进农村改革发展若干重大问题的决定》确立了积极鼓励土地承包经营权流转的政策。农村土地流转因此呈现出一副蓬勃发展的景象,为土地流转提供服务的中介组织也不断涌现出来。然而,在中介组织的发展过程中,出现了随意设立、职能不清以及从业人员素质低等问题。结合我国的实际情况,应当对中介组织的准入条件、职能和如何监管等制度作出必要的完善。

The Third Plenary Session of the Party's 17 'a number of major issues on rural reform and development' establish the policy to encourage circulation of land contracting.Therefore,circulation of rural land presents a scene of vigorous development,and emerge many intermediary organizations providing services for the land transfer.However,in the development of intermediary organizations,appear a series of question,such as free establishment,functions unclear and employees in low quality.At the basic of actual situation in our country,I has made some reasonable suggestions to how to set functions of intermediary organizations,and how to regulate it etc.
