摘要
缓起诉制度是起诉便宜主义的体现,它能够节约司法资源、促进犯罪人改造、实现特殊预防,故在不少国家的立法和司法实践中都得到体现。而由于没有法律的规定,缓起诉制度在我国只存在于一些地方检察院进行的试点中,而对其存在的合法性和可行性一直存在争议。缓起诉决定不是一个终局性决定,它没有侵犯法院的审判权,并具有独立的价值;而台湾地区的缓起诉立法例、我国现行的宽严相济的刑事政策以及各地的试点经验则为我国确立缓起诉制度提供了立法借鉴、政策根据和实践基础。
Suspended prosecution is a manifestation of the doctrine of prosecuting discretion,and is recognized by many countries in legislation and judicial practice,which can save judicial resources and promote the transformation of the criminals,to achieve special prevention.Because of the lack of the regulation of the law,suspended prosecution just exists in some experimental units of local procuratorate in China,and the legitimacy and feasibility of its existence have been controversial.The decision on suspended prosecution is not the final one,it does not infringe upon the court's jurisdiction,and has independent value.The legislation of suspended prosecution in Taiwan,the current criminal policy of combing punishment and leniency in China,and the pilot experience have provided legislative reference,policy and practice under the foundation for the suspended prosecution.
