空白票据补充权若干问题探析

空白票据是社会经济生活中不可避免的一种票据现象。为了使空白票据发生其应有效力,必须赋予持票人空白补充权。持票人对票据进行补记时就可发生使未完成的票据成为完全票据的效力。空白补充权是一种形成权,其权利人可以自由决定是否行使,其他人不能干预。在持票人行使空白补充权之后,空白票据成为完全票据,并且被视为自始存在票据权利,但任何权利人不得滥用这一权利。

The blank bills are inevitably in the social economical life.The bearer should have the additional right on blank bill so that the blank bills will be effective.The bearer can supply for the blank bill.The supplementary right is a kind of gestaltungsrecht,and the obligee has the right to decide whether he will exercise it or not.After the bearer exercise this right,the blank bills become fully bills.But nobody shall abuse this right.
