Conflict and Harmonization between the CCD and the WTO Agreements

《保护和促进文化表现形式多样性公约》的出台与生效可以说是人类进入21世纪以后,国际关系史和国际法体系方面的一个重大事件,该公约为国际社会解决文化与贸易的冲突提供了一个有力的WTO体制外工具,其工具性更多地体现在,如何将其对于文化多样性作为全球价值的肯定以及缔约国实施国内文化政策措施权利的规定融入到WTO自由贸易体制之内,通过文化贸易争端的合理解决真正建立全球文化促进机制。

The CCD(the Convention on the Protection and Promotion of the Diversity of Cultural Expressions) provides an effective tool to resolve the problem of culture and trade outside the WTO,which,to a very real extent,reflects that how to incorporate the confirmation of cultural diversity as the universal value and the provisions vesting the contracting countries with implementing national policies and measures on culture into the WTO system,and a prompting system of culture shall be established through settling cultural trade disputes reasonably.
