摘要
在房屋租赁关系中,我国法律规定了对承租人权利的特殊保护,即承租人优先购买权制度和买卖不破租赁制度。通过对有关房屋租赁权性质的几种学说进行分析比较,认为房屋租赁权既非单纯的物权也非单纯的债权,而是出现了租赁权物权化的趋势。在转租制度中,转租对出租人、承租人和次承租人的效力以及自行转租所产生的法律后果也是值得研究的课题。
China's related law stipulates the special protections of the leasee's rights,that are the institutions of the right of pre-emption for the leasees and business unbreaking leasing.This article comes to a conclusion from comparing and analying the different doctrines,that the essence of renting rights are neither simple real rights nor simple claim rights.They are developing into the real rights.At the end,the article comments on some related problems of the institutions of subletting,including the potency of subletting to lessors,lessees and sub-charterers and legal consequences of subletting when the lessors don't agree.
