企业是市场经济的主体,尽管我国市场经济体制已经确立,但与它一脉相承的企业法律制度还需要完善。资本制度作为现代企业制度的重要组成部分,对资本的筹集、运营和维持都发挥着重要作用,突出表现在公司这种企业组织形式中。关于公司资本制度,我们不能单一地评价孰好孰坏,孰优孰劣,而是要把它放置在具体的经济、文化、制度的背景下综合分析。

Enterprises are the main body of the market economy,while China's market economy system has been established,but as the same strain of market economy system,the corporate law system is still to be perfected.Capital system as a modern enterprise system,an important part of capital rising,operations and maintenance play an important role;the most prominent performance is the organization forms of the company.On the company's capital system,we cannot evaluate a single one good or bad,but to comprehensively analyze it in a specific economic,cultural and system context.
