试论对国家秘密争议的救济

On the Relief to National Secret Disputes

有权利必有救济,无救济即无权利,现有救济手段无论是行政复议还是行政诉讼,对国家秘密的争议解决皆存在不足。因此,有必要完善国家秘密的说明理由制度,强化公开指南和公开目录的编纂;建立定密异议制度与专家委员会裁决制度,完善国家秘密的行政复议。

Where there is a right,there is a remedy.Whether administrative reexamination or administrative proceeding,the existing remedies is deficient on the state secrets in dispute.Therefore,it is necessary to improve the explanation of state secrets,strengthen the compilation of public guidelines and public catalogues about government information,and rebuild the administrative reexamination,through establishing the opposing opinion system and the expert committee ruling system.
