摘要
房产纠纷案件也逐年上升。由房屋登记机关的具体行政行为而引发的行政诉讼案件也成为行政审判的重要案件类型。在其中民事与行政相互交叉的案件占了非常大的比重。由于立法欠缺、司法机制缺陷、理论建构缺失、法律解释与自由裁量技能不足,导致各地各级法院在司法实践中对于房产纠纷行政和民事交叉案件的审判程序、适用法律和裁判结果上均存在着较大的差异。很多案件虽经循环往复的民事诉讼与行政诉讼,却无法最终解决房产纠纷。
With the social and economic development,real estate has become an important community asset.Property disputes are also increasing every year.The administrative proceedings case,which is initiated by the house registration institution's concrete administrative action,becomes the important case type,in which the overlapping cases of civil and administrative has accounted for the very great proportion.Because the lack of legislative,judicial mechanism,theoretical construction,legal interpretation and discretionary skills shortage,leading to courts throughout china have big difference in the judicial practice of real estate disputes.Many cases despite the cycle of civil and administrative litigation cannot be ultimately resolved.
