有关犯罪本质的探讨有很多,但还有另一种途径来阐释,即通过人们习以为常的"情理法"这一基本生活话语出发,去反思、推敲、探析犯罪的本质,进而得出犯罪的本质是对维系社会秩序尤其是社会团结纽带的公众基本情感的严重侵犯,犯罪与刑罚是公众基本情感的两个维度这一基本结论。
