论侦查预审工作中的犯罪嫌疑人激励机制

On the Incentive Mechanism for Suspects' Voluntary Confession in Investigative Process

我国《刑事讼诉法》中规定犯罪嫌疑人对侦查人员的提问有如实回答的义务,但我国现行的"坦白从宽、抗拒从严"的刑侦政策过于原则,可操作性不强,加之侦查内部缺乏激励犯罪嫌疑人的配套制度,使得犯罪嫌疑人在接受侦查时本能地选择抗拒。在这种情况下,为了节约侦查资源,提高侦查活动效率,就必须构建相应的激励犯罪嫌疑人自愿供述的激励机制。

'Criminal Procedure law of the People's Republic of China' provides that the suspect has the obligation to answer investigators' question truthfully.But our current Policy of 'Leniency to Confessors,Severity to Resisters'is too principle and operability is not strong,coupled with the internal investigation lack of incentive mechanism supporting the suspect whcih makes criminal suspects choose resistance instinctively when they accept investigation.In this case,in order to save resources and improve the efficiency of investigative activities,the appropriate incentive mechanism for suspects' voluntary confession must be constructed.
