论民间规范义务——一种民间法哲学视角

On the Obligation of Folk Norm——A Jurisprudence Point of Folk Norm

法定义务并非义务的唯一形态,在法定义务之外尚有民间规范义务形态。民间规范义务是民间规范的重要组成部分,其可对民间规范权利起到必要的制约作用,并就社会秩序的维系而言具有重要意义。在法治语境下,民间规范义务有向法定义务进行转化之必要,民间规范义务的司法识别标准包括"应然"性质的规则主张和主体间的重复性行为,同时其既不能与法律规范义务相冲突,亦不能有悖于公序良俗。
