Research on the Implementation of China's Pollutant Discharge Permit

实行综合化、一证式管理的排污许可证制度是我国当前污染治理的重大改革。排污许可证在实施中逐渐暴露出执法依据供给不足、缺乏法律化的最佳技术体系和最优管理体系支撑、缺乏与相关环境管理制度的深入全面整合、公众参与排污许可证执行规制不足等问题,应构建系统全面的排污许可证立法、完善法律化的最佳技术体系和最优管理体系、扎实整合排污许可证与相关环境管理制度、强化排污许可证从申请到执行的全程公众参与。

It is China＇ s current major reform that a comprehensive, one-license system will be implemented for pollutant dis- charge permits. In the past enforcement progress of pollutant discharge permit, the following problems have been gradually ex- posed ： Enforcement basis is in short of supply, lack of the legalization of optimum technical system and optimal management sys- tem, lack of in-depth and comprehensive integration with relevant environmental management systems, public participation in the implementation of pollutant discharge permits is insufficient. The comprehensive legislation of pollutant discharge permit should be constructed systematically. The legalization of optimum technical system and optimal management system should be improved. The pollutant discharge permits should be steadily integrated with the relevant environmental management systems. Public participation in pollutant discharge permits should be enhanced from application to implementation.
