英烈保护司法实务问题探析

On the Judicial Practice of the proyection of the Heroes and Martyrs

司法实务中英雄烈士的姓名、肖像、名誉、荣誉等权益受法律保护,应认真研究其操作性,厘清保护对象、诉讼程序启动主体及方式,解决行政、民事及刑事责任交叉与衔接问题,划分学术研究与侵犯英烈人格利益及侮辱、诽谤的界限,慎重适用调解、和解并明确损害赔偿范围与标准,适时通过司法解释的形式予以明确规定。

The name, portrait, reputation, honor and other rights and interests of the heroes and martyrs are protected by law in the judicial practice. First of all, we should study carefully its operability and clarify the object of protection, the subject and methods of the lawsuit initiation. Then, we should solve the problem of overlapping and bridging in administrative, civil and crim- inal responsibilities and divide the academic research and the boundaries of the infringement of the personality interests, insult and libel. Conciliation and reconciliation should be carefully applied.In the meanwhile, we should clarify the scope and standard of damages.In due course, it should be stipulated clearly through judicial interpretation.
