晚退休背景下“余热权”的法律保障

摘要 余热权是指劳动者退休之后,继续以工作者的身份投身到原单位或者全新的单位工作。这应是劳动者的一项基本权利,为此需要将其纳入劳动法的保障范围。老年人不仅要"老有所养",更要"老有所为",为此需要采取一系列措施,以消除余热权的法律障碍。 “The right of afterheat” refers to the right of retired workers who are re-employed by the original or a new unit as worker’ identity. It ought to be a fundamental right of workers, so it needs to be included in the protection scope of labor law. The elderly should not only “ be looked after properly when they grow old”, but also “accomplish something in their old ages”. Therefore, it is necessary for us to take a series of measures to eliminate the legal obstacles to the right of afterheat.
