The Study on Zhouyi and the Traditional Chinese Law Ethics

《周易》是中国传统文化之源,蕴涵着丰富的中华传统法文化内涵。从伦理视域看,主要体现为遏恶扬善、顺天休命的传统法精神,明慎用刑、议狱缓死的传统慎刑理念,赦过宥罪、小惩大诫的刑罚教化功能,刚健中正、金矢艰贞的公平正义原则,谨言慎行、止争息讼的和谐价值追求。

Zhouyi （or The Book of Changes） , as one of sources of Chinese traditional culture, contains a plenty of the thought of law-. It is shown by the following ideas in the field of the judicial ethics： the idea of punishing evil-doers and praising good-doers in the traditional Chinese law-, prudence in punishment, the moralization function of penalty through forgiveness as well as punishment of a trivial offence, the principle of justice, the pursuit of harmonious society through reconcilement and non-litigation.
