设区市立法保护历史文化的制度设计初探

Preliminary Study on the System Design of the Protection of History and Culture by the Legislation of City with Districts

我国既往的地方立法在保护历史文化的制度设计方面存在诸多不足。新获授权的设区的市在进行历史文化立法保护的制度设计上,应当确立和遵循合法、创新和人本等三项基本原则,并应主要围绕类型化保护、本土化保护、社会化保护、商业化保护和数字化保护等制度架构进行立法设计。

There are many deficiencies in the system design for the protection of history and culture in the previous local legislation of China. The newly authorized cities with districts should establish and follow the three basic principles of legality, innovation and humanism in the design of the system for the protection of historical and cultural legislation. And the legislative design should mainly focus on these institutional frameworks： categorized protection, localized protection, socialized protection, commercial protection and digital protection.
