摘要
制度如何演化受到学者的日益关注。但是目前的研究主要关注发达经济体中的制度变迁。相比之下,新兴经济体背景下的制度变迁过程还未得到充分分析。本文借鉴了新制度主义关于制度变迁的视角,分析了中国劳动合同制度的起源以及不断演化的历史过程,在此基础上讨论了该制度在面临市场压力的情况下与发达经济国家制度演进方向的趋同问题。作者认为,从演进模式上来看,中国劳动合同制度的变迁模式是一个自我加强的逐渐演进过程;从演进方向来看,与发达市场经济国家相比,中国劳动合同制度演进的方向是先趋异再趋同的历史过程。
How the institution evolved has attracted increasing attention from scholars. But the current research concentrates on the theme in the context of advanced economies. In contrast, institutional changes in emerging economies have not been fully analyzed. This paper uses the evolution of China's employment institution as an example from the perspective of institutional change and the new institutionalism. This paper discusses the convergence of the institution in China when facing the market pressure. According to the author, the change mode of employment institution is a self-amplifying process. From the perspective of evolution, the evolution of China's employment institution is the historical process of divergence in the first stage and then of convergence in the second stage, compared with developed market economy countries.
