摘要
专利质量问题由来已久,专利质量控制按阶段可分为审前控制和审后控制,专利无效宣告程序被称为专利质量审后控制的制度。本文运用数理模型研究了专利无效宣告程序的质量控制机制,并对其控制效率进行数据分析,指出专利无效宣告程序在填补专利审查漏洞的基础上发现并消除了更多低质量专利。在分析影响无效程序质量控制因素的基础上,提出制定具有法律约束力的现有技术披露规则、引入无效宣告的简易程序审理模式、对成功的无效宣告人设置第三方奖励机制等政策建议。
The patent quality problem has been in existence for a long time, and the patent quality control can be divided into pre-trial control and post-trial control according to the stage. The patent invalidation procedure is called the system of patent quality after-the-fact control. This paper uses the mathematical model to study thequality control mechanism of the patent invalidation procedure, and analyzes the data of its control efficiency that the patent invalidation procedure found and eliminated more low-quality patents on the basis of filling the patent review loopholes. On the basis of analyzing the factors affecting the quality control of invalid procedure, this paper proposes the formulation of legally binding prior art disclosure rules, the introduction of a simplified procedure for invalidation, and the establishment of a third-party incentive mechanism for successful invalidators.
