我国未成年人犯罪刑事政策的历史检视与现实应对——以“教育”和“惩罚”的协调为视角

Historical Inspection and Realistic Coping Method for Juvenile Crime Policies in China——From the Perspective of Balancing “Education” and “Punishment”

我国对于未成年人犯罪主要采取"教育为主,惩罚为辅"宽严相济的形事政策,但实践中存在处罚"过重"或"过轻"、制裁矫治措施不完善等问题。由此反思,我国关于未成年人犯罪的刑事政策过于强调"教育",而忽视"惩罚",应当从重视惩罚和教育措施相协调的视角进行完善。

In China, the major criminal policy for juvenile crime is based on the principle of ＂education first, punishment second＂, however, in practice there are problems such as ＂overcharging＂ or ＂ undercharging＂. Reflecting on this, these policies stress ＂ education＂ more than ＂punishment＂. It is suggested to balance the two elements.
