浅析非公有制林业发展及其法制建设

近年来,以林地使用权和所有权分离为核心,多种非公有制经济成分参与林业建设为契机,非公有制林业建设在全国各地得到了蓬勃发展,显示出了不可挡的趋势。党的十六大进一步确立了非公有制经济的发展地位,非公有制林业发展将进入一个新的时期.但由于非公有制林业经济刚刚起步,没有形成一个完善的体系.致使在具体操作中,存在着许多问题.本文从分析非公有制林业存在的问题出发,提出具体解决措施,强调了完善非公有制林业法制建设的重要性,及其立法建议.希望能够更加完善非公有制林业的法制建设.

In recent years, with forest land’s usufruct being separated from ownership as core, many kinds of non-public economic sectors participate in forestry's construction for the opportunity, the non-public forestry construction has been grown vigorously in all parts of the country, which has demonstrated the irresistible trend. The 16th National Congress of Communist Party of China has established the development position of non-public economy further, non-public forestry's development will enter a new period. But because non-public forestry's economy has just started, have not formed a perfect system which causes a lot of questions in operating concretely. This text proposes the solving measures concretely from analysing the non-public forestry's existing problem, put emphasis on the importance of perfecting non-public forestry's legal construction, and legislate advice. Hoping to perfect the legal construction of the non-public forestry further.
