社会主义核心价值观入法的理论基础、现实需求及实现路径

The Theoretical Basis, Realistic Needs and Implementation Pathway of Integrating Socialist Core Values into Laws and Regulations

作为新时期全体人民共同的价值追求和社会发展的精神指引,社会主义核心价值观与社会主义法的价值具有很大程度的精神契合。入法入规有助于核心价值观的认知、传播、培育和践行。核心价值观引领立法的方向和品质,并对法律的遵守和适用提供精神动力和制度保障。现有法律法规对社会主义核心价值观的导向、践行和保障等方面还有不足。社会主义核心价值观入法必须遵循法律至上科学立法的准则,以问题为导向选好立法重点领域,充分利用目的性原则性条款,保障法律规则的可操作性,将核心价值观贯穿立法、修法、废法、释法及司法全过程。

As the common spiritual pursuit of all the people and the guidance of social development in the new era, socialist core values runs parallel with the values of socialist law in spiritual integration to a great extent. To integrate socialist core values into laws and regulations may facilitate the recognition, publicity, cultivation and practice of the values. Core values lead the direction and quality of legislation and provide spiritual motivation and institutional guarantee for the compliance and application of the law. However, our current legal system are still insufficient for the guidance, practice and guarantee of socialist core values. The integration of socialist core values into laws and regulations shall abide by the principle of"the supremacy of law"and"scientific legislation", select the key areas of legislation with the orientation of solving problems, make full use of clauses with purposes and principles, ensure the exercise of laws and regulations, and pass the core values through the whole process of legislation, amendment, repeal interpretation and enforcement of the laws.
