Super Ministry System Reform and Its Public Law Under the Guiding Principle of Constitution-based Governance

在全面推进依法治国、加快建设法治政府的进程中,应当深刻认识从中国共产党第十八次全国代表大会到第十九次全国代表大会,中国特色社会主义法治政府建设的若干重要背景因素变化,须要关注十九大报告、十九届三中全会决定和方案、2018宪法修正案提出的诸多新课题,特别是如何通过创新监督体系高质量地建设法治政府。发展中国特色社会主义法治理论,根据我国社会政治条件和历史文化传统推动民主政治及其法治体系,构建决策科学、执行坚决、监督有力的权力运行机制,通过观念更新、制度创新、把握特色,科学推进依宪治国执政方针下的大部制改革,认真解决诸多公法疑难课题,逐步实现行政法治文化革新,方能更理性、更稳健地推动法治政府建设,实现法治国家、法治政府、法治社会一体建设目标。

In the process of comprehensively advancing the rule of law and accelerating the construction of a law-based government, we must profoundly understand the significant background changes of constructing a law-based government of socialism with Chinese characteristics from the 18th National Congress of the Communist Party of China to the 19th National Congress. We need to pay attention to the decisions and programs of the 19th National Congress and the Third Plenary Session of the 19th Central Committee, and the new constitutional issues proposed by the 2018 Constitutional Amendment, especially how to build a law-based government with high quality through innovative supervision systems. We shall endeavor to develop the theory of rule of law of socialism with Chinese characteristics, promote democratic politics and its rule of law system in accordance with China＇s social and political conditions and historical and cultural traditions, and construct a power operation mechanism with scientific decision-making, resolute implementation and powerful supervision. Through renewed ideas, institutional innovation and grasping the characteristics, we can scientifically promote the super ministry system reform under the guiding principle of constitution-based governance, solve many difficult problems of public law, and gradually re- alize the innovation of administrative rule of law culture, which can help promote the construction of a law -based government more rationally and steadily, and realize the integrated goal of building a country, government and society under the rule of law.
