摘要
法的价值是立法的思想先导。依据韦伯的类型学,美国职业教育法的价值内容可以分为实质价值与形式价值。美国职业教育法的实质价值有服务个人生涯目标的生涯教育观,以追求卓越为核心的新职业主义观,不平等补偿原则下的教育公平观;形式价值包括融入新公共管理思想的"新联邦主义",以追求合法性为目标的法律活动程序民主化,以追求合理性为目标的法律活动程序科学化。美国职业教育法的价值追求实质与形式的统一,融入美国的实用主义精神,共同支持职业教育法律目标的实现。
Value of the law is the conceptual guide for legislation. Value of American vocational education law could be split into substantial value and form value according to Weber' s typology. Substantial value orientation was embodied in conception of career education, new vocationalism centering predomination, idea of education equity under the principle of compensation for inequality; form value orientation consists of new federalism integrated into thought of New Public Management, democratization on procedure of legal action aiming at legality, scientification of legal proceedings pursuing rationality. Overall, American vocational education law, getting substantial value and form value united, integrates into pragmatism for realizing the objective of the law.
