我国政府购买法律服务制度的实践考察——构成要素、运行现状与优化路径

政府购买法律服务已成为我国政府部门应对日益复杂的公共法律事务工作的必然制度选择。通过考察实践中我国政府购买法律服务制度运行的现状,可以发现我国政府购买法律服务制度存在着诸如制度缺乏系统性、程序运行缺乏规范性、缺少费用标准以及缺乏对承接主体的参与激励等问题。由此,今后我国政府购买法律服务的制度建设可从设定政府购买法律服务内容、建立政府购买法律服务资金预算管理机制、搭建统一的法律服务信息公共网络平台以及完善监督管理制度和绩效考核制度等方面进行优化。

The government＇s purchase of legal services has become an indispensable institutional choice for Chinese government departments in dealing with increasingly complex public legal affairs. By analyzing the characteristics of the operation of the Chinese government purchase of legal service＇s regime in practice, the elements of the system can be basically summarized. However, it can also be found that there are some problems in the practice of purchasing legal services carried out by local governments, such as the lack of systematic system, in the operation of procedures lack standardization and cost standards, and it also lacks participation incentives for the recipients. Therefore, the current Chinese government＇s system for purchasing legal services should set purchase content according to local conditions, establish a government budget mechanism for purchasing legal services funds, establish a unified public service platform for legal service information, and improve strict supervision and management system and performance appraisal system, and optimize in other aspects.
