摘要
我国有关婚姻家庭的法律有婚姻法、收养法,行政法规有婚姻登记管理条例,司法解释有十多个,与婚姻家庭有关的法律有继承法等。现行调整婚姻家庭关系的主要法律是婚姻法,但内容不够完善,体系不尽合理。修订婚姻法,需要考虑以下问题。一、法律名称及其调整范围法律名称应当涵盖其所调整的法律关系,起到顾名思义,一目了然的作用。我国现行婚姻法调整范围包括婚姻关系和家庭关系两部分,而法律的名称却易使人望文生义地理解为婚姻法只是调整婚姻关系。从实际生活看,婚姻关系与家庭关系密不可分,所以学术界绝大多数认为,婚姻法修订后应当更名为“婚姻家庭法”,使之全面、客观、清晰地表达该法的调整对象。
In China,the Laws related to marriage and family are Marriage Law,Law of Adoption and Law of Inheritance,the relevant administrative rules are Regulations on Registration of Marriage, and there are ten odd judicial interpretations.The Marriage Law is the current principal law adjusting marriage and family rela- tionships but is not perfect enough and not reasonable enough systemically.The problems needing considera- tion in revision of the Marriage Law are concerned with(1)title of the Law and extent of adjustment,(2)kin and degree of kinship,(3)family relationships,(4)marriage,(5)system of establishment of invalid marrige, (6)substantial important conditions of divorce,and(7)system of husband-and-wife's property.
