2003-2014年社会舆论关注的重大司法案件基本特征和传播效果研究

Research on the Basic Characteristics and Communication Effects of Major Judicial Cases Concerned by Public Opinion(2003-2014)

层出不穷的重大司法案件,为中国社会舆论提供了源源不竭的关注动力。舆论和司法关系的研究由来已久,从研究特征主体的角度看,大体存在两种思路：一种是＂个案演绎型研究＂,通过深入剖析诸如药家鑫案、彭宇案、邓玉娇案等重大司法个案,探讨舆论和司法的协调共处机理。另一种是＂趋势直觉型研究＂,即按照一定的标准,将各种类型的司法个案并联分析,探讨宏观性、阶段性、趋势性的特征。本文采取后一种研究方法和思路,综合运用描述统计、交叉分析等方法,分析2003—2014年这12年间被中国社会舆论高度关注的146起重大司法案件的基本特征以及舆论传播的效果,归纳其基本特征,探寻在中国社会大环境下舆论和司法的动态平衡和良性互动之路。

After a large number of major judicial cases,China＇s public opinion has provided a steady stream of attention. Study on the relationship between public opinion and judicial characteristics of long-standing,from the perspective of the subject,there are mainly two ways： one is＂case interpretation research＂,through in-depth analysis such as Yao Jiaxin case,Peng Yu case,Deng Yujiao case and so on,the harmonious coexistence mechanism of public opinion and judicature. The other is＂trend intuitive research＂,that is,according to certain standards,the various types of judicial cases will be analyzed in parallel,to explore the characteristics of macro,stage and trend. This paper adopts the second research method and ideas after a comprehensive use of descriptive statistics,cross analysis,analysis of the basic characteristics of the 12 years from 2003 to2014 Chinese public opinion is highly concerned about the 146 major judicial cases and the effect of public opinion,summarized the basic characteristics,to explore in the environment of Chinese society under the dynamic balance of public opinion and judicial and interactive road.
