改革开放四十年中国宪法学的回应与贡献 以20世纪八十年代的宪法学研究为中心

40Years of Reform and Opening Up:The Response and Contribution of Chinese Constitutional Legal Studies Centered on the Research of Constitutional Law in the 1980s

改革开放40年与宪法发展的良性互动是学界需要深入研究的课题。实践说明,宪法对改革开放发挥了引导、规范与保障的作用,而这种作用需要宪法学提供有力的理论支撑。在改革开放40年来的不同阶段,面对改革实践中提出的新情况、新问题,宪法学以问题为导向,在正当性与合法性、规范与事实的冲突中坚守学术的专业精神,积极履行学术的社会责任。特别是,改革开放起步的20世纪八十年代,中国宪法学面向改革开放的实践,创新基本理论,建构学术话语,提高理论的解释能力,为改革开放的开启提供了丰富的学术资源。

The virtuous interaction between the 40 years of ＂reform and opening up＂ and the develop-ment of the constitution is a subject that needs to be researched in depth. The practice shows that the Constitution of PRC plays an important role in guiding, regulating and guaranteeing the ＂reform and o pening up＂, and the role requires theoretical support from constitutional law. At different stages of the ＂reform and opening up＂, in the face of new situations and new problems in practice, constitutional law is problem-oriented and reflects professionalism and social responsibility in the conflict between legiti macy and legitimacy, norms and facts. In particular, in the 1980s when the ＂reform and opening up＂ be-gan, the research of Chinese Constitutional Law was oriented toward the practice of the ＂reform and o pening up＂, innovating basic theories, improving explanatory power, which provided abundant theoreti cal resources for the beginning of the ＂reform and opening up＂.
