论民间规范与地方立法的融合发展

On the Integrated Development of Folk Norms and the Local Legislation

在"法治国家、法治政府、法治社会一体建设"和《立法法》修改后地方立法主体扩容的背景下,应充分关注民间规范与地方立法的融合发展问题。基于对立统一关系的原理,民间规范与地方立法存在融合发展的基础;民间规范的社群性、传承性和经验性分别能沟通地方立法的地方性、固有性和执行性,又使得二者具备融合发展的可能。当然,二者融合发展也面临一定的障碍,如民间规范守成,地方立法却创新;民间规范自发,地方立法却建构;民间规范自下而定,地方立法却据上而立等。但这些障碍并非不可消解,亦即二者不能融合发展的命题是可以被"证伪"的。民间规范与地方立法融合发展的具体路径为:民间规范先导地方立法,地方立法吸收民间规范,民间规范补充地方立法,地方立法规引民间规范,呈现出双向互动的循环态势,助推全面依法治国及国家治理现代化的进程。

Against the background of establishing a law-based country, government, and society and expanding the local legislative power according to the amended Legislation Law, it is necessary to give more attention to the integrated development of folk norms and the local legislation. Based on the princi-ple of unity of opposites, we can infer that there is the potential to achieve the integrated development of folk norms and the local legislation. Folk norms＇ characteristics of sociality, inheritance and experience echo the local legislation＇s characteristics of locality, inherence and enforceability respectively. Admitted-ly, folk norm ~s characteristics of conservatism, spontaneity and bottom up approach contradict with the local legislation＇s characteristics of innovation, construction and top-down approach, which brings barri-ers to the integrated development of folk norms and the local legislation. However, such barriers are not insurmountable. In other words, the negative proposition of the integrated development of folk norms and the local legislation is falsifiable. The possible approach to achieving the integrated development of folk norms and the local legislation is： folk norms introduce the local legislation; the local legislation absorbs folk norms＇ folk norms supplement the local legislation; the local legislation guides and regulates folk norms, which demonstrates a two-way interaction and boosts the process of comprehensively advancing the rule of law and modernization of governance capability.
