印度环境司法专家成员制度研究

Studies on the System of Expert Members in India's Environmental Judicature

印度国家绿色法庭是专业处理环境类案件,以司法手段扭转印度国内环境危机而设立的专门性法院;其"走到普通人中间去的"环境司法理念,以及诸如多数成员共同判决制度、专家成员制度等先进的环境司法制度,可以为有着较为相似的发展境况和人口条件的我国借鉴学习。以专家成员制度为研究对象,探讨专家成员从选任到实际的司法裁判过程以及其在司法裁判中的权利与义务,并将其与中国环境司法中解决环境专业问题的方式相比较,我国应该去其糟粕,取其精华。

The National Green Tribunal of India is a special court established to deal with the environmental cases and tackle the environmental crisis in India by judicial means. Because China and Indian have the similar sitaation in development and population, the methods of the tribunal are useful to us, such as the environmental justice ideas of ＂getting common people involved＂, ＂decision to be taken by majority＂ and the system of expert members, Targeting the system of expert members in the National Green Tribunal of India, this paper studies how the expert members are selected, their rights and obligations in judicial adjudication. By comparison, it is stated that, in the judicial practice of environmental cases, China should reject the dross and assimilate the essence from Indtia＇s practice.
