摘要
作为法家的集大成者,韩非对先秦诸子的思想进行了批判性继承,为其法家思想的产生奠定了坚实的理论基础。其法治思想简言之就是:非先圣,反传统,批孔墨,变老庄;其理论核心是通过加强君主专制强化中央集权;其目的是为了打击没落的奴隶主贵族势力,壮大新兴地主阶级,为封建帝王提供统治术而维护封建专制制度,与今天的法治有着本质的区别。
As a master of Legalism, Han Fei critically inherited many thoughts of pre-Qin scholars and laid a solid theoretical foundation for the emergence of Legalism. The main idea of his thought simply is: to disagree the saint, to oppose tradition, to criticize the doctrine of Kong and Meng, to change Lao-Zhuang philosophy. The core of the theory is to strengthen centralization by strengthening monarchy. Its purpose is to attack the declining slave-owners and aristocrats, to strengthen the new landlord class, to maintain the rule of the feudal emperor and the feudal autocratic system, which is essentially different from today's rule of law.
