康德的法权(Recht)是否从道德推出——对康德法权哲学与道德哲学关系的探寻

一问题的引出：关于＂法权论＂与＂道德形而上学＂关系的争论近年来,康德的《法权论》引起了一些学者的关注和兴趣,围绕着一系列问题展开了讨论：康德为何把法权论作为道德形而上学的第一部分,《法权论》和《道德形而上学》究竟是何种关系;康德如何在绝对命令的基础上建立法权（正当）形而上学,法权（正当）的普遍原则与绝对命令的关系如何,它对应着绝对命令的哪个公式等。

With the rise of contemporary political philosophy,Kant＇s right philosophy attracts the attention and concern of modern Kantian scholars and libertarian gradually,who start to revaluate it and make the critical development,and at the same time,try to revive Kant＇s right philosophy.The relationship between right philosophy and moral philosophy,that is,the legitimacy of Kant＇s Recht,becomes the focus of issues.In Kant＇s ethics,right and morality keep a certain tension in a special way between each other.On the one hand,right and morality keep an internal connection between each other,that is,the concept of right arising from moral freedom and value of the supreme moral law,which is the outer freedom of practical reason.On the other hand,in the process of externalization of freedom,right gradually separates from morality,as the existence of independence of morality.
