法治思想是人们关于法的基本问题的认识与阐释,诸如法的起源、内容、形式、本质等重要问题,早在马克思主义诞生之前,就已经进入西方思想家们的视域之中。可以说,西方法治文化与法学理论所积累的丰富的思想素材,为马克思主义法治观的孕育提供了丰厚的文化土壤,尽管西方绝大多数思想家的观点理论和立论基础并不是在科学的世界观和方法论指导下的阐发,但在他们关于法治的基本观点和总体看法中仍不乏许多真知灼见和理论成就,至今仍对我们正确认识法治的历史地位、发展规律等问题具有重大借鉴意义。

The thought of rule of law is people＇s understanding and explanation of the basic problems of law, such as the origin, content, form and essence of law, which entered the horizon of western thinkers long before the birth of Marxism.？The rich ideological materials accumulated by the western rule of law theory provide rich cultural soil for the breeding of Marxist view of rule of law.Although most western thinkers＇ theories and theories are not explained under the guidance of scientific world outlook and methodology, there are still many insights and theoretical achievements in their basic views and general views on the rule of law, which still have great significance for us to correctly understand the historical status and development laws of the rule of law.
