《蒙古秘史》是蒙古民族的历史、文学古典名著。纵观其内容,涵盖了历史、文学、民俗、军事及法学等多个学科。仅从刑事法学的重要内容——刑罚体系视角,分析《蒙古秘史》12卷282节之全部内容,所涉现代意义刑罚体系问题的还很多,如死刑、笞杖罚、放逐、没收财产、戴板枷等。尤其以死刑为核心的刑罚问题更具研究、探讨价值。如"凡比车辖高的人全部杀光"、"致人不流血而死"等。分析研究这些问题,使得《蒙古秘史》研究更加完备。

The Secret History of the Mongols, a historical and literary classic of Mongolian people, covers many subjects such as histories, literature, folk customs, military sciences and laws. From the perspective of penalty system, which is an important part of criminal law, this paper analyzes the whole content of Volume 12, Section 282 of The Secret History of Mongols. There are many problems concerning the modern penalty system, such as death penalty, cane punishment, exile, confiscation of property, wearing cangue and so on.In particular, the penalty issue centered on death penalty has great value to study, for example, “anyone who is taller thanaxle-pins should be killed”,“ to kill people without bloodshed”. Analyzing and studying these problems makes the study of The Secret History of Mongols more complete.
