摘要
特有包装装潢是通过在市场经营活动中使用而获得具有识别商品来源的显著特征的一种商业标志,受到《反不正当竞争法》保护。但是,其权益归属长期以来一直困扰着司法实践,同时也是学术界特别关注的话题。2017年8月16日,最高人民法院就广药集团与加多宝公司关于王老吉凉茶的"红罐包装装潢"权益归属作出终审判决,其适用的学说理论可以归结为"诚实贡献论"。与此相对的一项理论是"商标依附论"。这两种学说都只能在具体纠纷案件中根据具体情形慎重适用,并不能作为适用于一切纠纷的通说。
