司法民主中公民参与模式的文献述评与路径创新

Literature Review and Path Innovation of Citizen Participation Mode in Judicial Democracy

通过整理现有研究成果发现，司法民主核心议题是公民参与，并已形成“人民陪审一人民监督”的双轨制参与模式。但同时也暴露出对司法民主中公民参与问题的研究很不平衡的缺陷，主要有：一是研究方向不平衡，集中于审判阶段的公民参与而忽视了更加广泛的司法活动；二是研究方法不平衡，集中于规范分析而欠缺面向实证法学的相关路径；三是内涵外延不平衡，将司法民主限定为法院的审判活动，把行政活动中“准司法”问题排除在外。因此，应当尝试开阔司法民主中公民参与新路径，建立互动沟通机制，指导型案例评价机制、“互联网＋”背景下的创新参与模式等，将更加广泛的司法活动纳入民主的框架内。

By sorting out the existing research findings, the core issue of judicial democracy is the participation of citizens,and has formed a dual- track participation model of ＂people＇ jury and people＇s supervision＂. But the defects are also exposed that the study of problems of citizen participation in judicial democracy is very uneven：one is the re- search direction is not balanced, which is focus on the trial of civil participation but overlooking the more widely judicial activities. Secondly, the research method is unbalanced, which is focusing on normative analysis but lacking the relevant path of empirical law. The third is the unbalanced connotation that the judicial democracy is limited to the judicial activ- ities of the court, and the ＂quasi -judicial＂ issues in administrative activities are excluded. Therefore, it is important to open new paths of citizen participation in the judicial democracy, such as establishing interactive communication mecha- nism, guiding case assessment mechanism and under the background of ＂Internet ＋ ＂ innovation mode and so on. This will make the more widely judicial activities into the framework of democracy
