“Fengqiao Experience”in the Construction of“Macro-mediation”System——a New Approach to Diversified Dispute Settlement Mechanism

"大调解"作为中国特色的矛盾纠纷解决方案,具有存在的合理性和积极作用。但以往的"大调解"运行中出现了一些偏离法治思维、抑制基层自治活力的副作用。作为"枫桥经验"诞生地的诸暨市,在创新"大调解"体系方面进行了积极探索,在推进"大调解"建设的法治化、社会化、专业化、智能化等方面,都取得了良好效果,丰富和发展了新时代的"枫桥经验",也为完善多元化纠纷解决机制与基层社会治理的"中国方案"提供了镜鉴。

＂Macro mediation＂, as a solution with Chinese characteristics, plays a reasonable and positive role in dispute settle ment. However, some side effects arose in its operation, which deviated from the principle of rule of law and restrained the au tonomy at the grassroots level. Zhuji City, the birthplace of ＂Fengqiao Experience＂, has actively explored a new approach in the innovation construction of ＂macro mediation＂ system and made remarkable achievements in its legalization, socialization, professionalization and intelligentization, which have not only enriched ancl advanced ＂Fengqiao Experience＂ in the new era, but also offered valuable experience for the diversified dispute settlement mechanism and the ＂Chinese approach＂ of grassroots governance.
