跨域治理视野下长三角城市群政府事权划分:逻辑进路与法治保障

The Authorization Clarification in the Yangtze River Delta Urban Agglomeration from the Perspective of Interterritorial Governance: Logical Approaches and Legal Safeguard

面对长三角城市群内政府事权划分的模糊现状,为达致长三角区域整体协调发展与跨域协同治理的基本目标,以跨域治理为视角切入城市群内部政府事权划分并勾勒城市群内政府事权归属界限。基于中国单一财政体制的现实局面,描绘以垂直向度与水平向度为网格的长三角城市群政府事权划分基本思路,依据对公共产品的层次性区分和横向协同需求进行政府事权配置。回归法治路径,拟定由财政基本法划定城市群内部央地事权的界限,并在区域协同组织统一配置跨区域事权的顶层设计。涉及横向协同层面则在财政基本法所列明之横向财政转移支付规范与各地人大对长三角基金的预算硬约束下,建立以长三角基金为主要运作机制的横向转移支付制度。

Facing the vague situation of authorization clarification within the Yangtze River delta urban agglomeration,the authorization clarification in the delta urban agglomeration shall be built up,in order to achieve the goal of harmonious development of the region. Based on the reality of China＇s financial political system,the main idea for the authorization clarification can be depicted with the vertical and horizontal dimension. Return to the path of the rule of law,we should draw up the top-level design that demarcates government＇s authority by the financial basic law. In terms of horizontal dimension,a horizontal transfer payment system based on the Yangtze River Delta Fund should be established within the constrained of the local People＇s Congress.
