新闻聚合APP的著作权侵权问题探究——以“今日头条”深层链接行为为视角

Research on Copyright Infringement of News Aggregation APP——from the Perspective of “Today’s Headline” Deep Link Behavior

＂今日头条＂是新闻聚合APP中的典型代表,关于深层链接行为是否构成＂提供作品＂行为的认定,有＂用户感知标准＂、＂服务器标准＂和＂实质呈现标准＂三种观点。在司法实践中法院多采取＂服务器标准＂,但固守该标准不足以应对实践中各种复杂的侵权情形。以＂服务器标准＂优先判定,辅之以＂实质呈现标准＂,则能对深层链接行为做出更准确的认定。鉴于新闻聚合APP深层链接行为具有两面性,可以通过增强避风港原则的可适用性,创新私立制度,从而实现技术创新与著作权保护的利益平衡。

Taking ＂server standards＂as priority judgement and＂substantive presentation standards＂as supplement,we can make a more accurate identification for deep link behavior. Due to the deep link of news aggregation APP has two sides,by enhancing the applicability of the safe harbors principle and innovating private system,we can realize the balance between interests of technological innovation and copyright protection.
