著作权集体管理组织反垄断研究

著作权集体管理制度,基于其规模效应,是行使著作权最为实用、最为经济的方式。目前我国存在多家著作权集体管理组织,然而,现存的组织不仅未能实现制度设计之初的预期,反而在一定程度上阻碍了著作权产业的发展。世界各国多从组织设立、行为标准、监督管理等方面入手规制著作权集体管理组织的垄断行为。他山之石,可以攻玉：降低准入门槛增加竞争、完善监督机制、重塑价值基础等措施亦为解决我国著作权集体管理组织垄断的良方。

The collective management system of copyright,based on its scale effect,is the most practical and economical way to exercise copyright.At present,there are many copyright collective management organizations in China.However,they have not only failed to meet the initial expectation of system design,but also become a hindrance to the development of copyright industry.Most countries in the world begin to regulate the monopoly of copyright collective management organizations from the aspects of organization establishment,standards of conduct,supervision and management.It is no doubt that the best way to solve the problem of monopoly of copyright collective management organization in China is to reduce entry barriers in order to increase competition,improve the supervision mechanism and rebuild the value foundation.
